USCIS introduces Automatic Employment Authorization Document Extension to Enhance Work Access

Automatic Employment Authorization Document Extension : In a significant move aimed at improving access to work permits for eligible noncitizens, USCIS has introduced a temporary final rule (TFR) increasing the automatic extension period for certain Employment Authorization Documents (EADs) from up to 180 days to a substantial 540 days. This initiative builds upon the extensive modernization efforts undertaken by USCIS to streamline processes and enhance efficiency, particularly in the realm of work permits.

This announcement comes in the wake of considerable progress made in reducing processing times for EADs over the past year, reflecting the agency’s commitment to facilitating employment for eligible individuals. The extended automatic extension period is designed to prevent work-authorized noncitizens from experiencing lapses in their employment authorization while awaiting the adjudication of their pending EAD renewal applications.

USCIS Director Ur M. Jaddou emphasized the agency’s dedication to improving work access, stating, “Temporarily lengthening the existing automatic extension up to 540 days will avoid lapses in employment authorizations.” This move not only ensures continuity of operations for U.S. employers but also aligns with the Biden-Harris Administration’s efforts to integrate work-authorized individuals into the workforce, thereby bolstering local economies.

The temporary measure reflects USCIS’s ongoing commitment to supporting employment-authorized individuals’ access to work opportunities. Key achievements in this regard include reducing EAD processing times, engaging with communities to enhance awareness and accessibility, and streamlining adjudication processes.

It’s noteworthy that this temporary measure will particularly benefit nearly 800,000 EAD renewal applicants, including those eligible for employment authorization as asylees or asylum applicants, Temporary Protected Status (TPS) applicants or recipients, and green card applicants. Moreover, approximately 60,000 to 80,000 employers stand to benefit from avoiding disruptions due to potential lapses in employment authorization.

Crucially, USCIS is soliciting feedback from the public to inform potential future regulatory action, underlining its commitment to transparency and stakeholder engagement.
